About Entities or Physical Individuals Listed

Depending on the country where you are regulated it may be illegal to conduct business with persons within this list, if you found a positive match while running an AML Check being or not a Financial Institution or Bank you need to consult with your legal or compliance team, in some jurisdictions you must receive special authorization to conduct business from positive matches in others you may be in violation of local regulations if engaging with individuals on this DB.

What to do if I found a positive

What information does the GFIEN has on me

The GFIEN may not include information on Entities or Individuals that are not considered a high or substantial risk to Banks or Financial Institutions nor those that are not contained in a Government issued Sanction List, however the GFIEN may contain information provided by member Banks and Financial Institutions.
The information contained on the GFIEN is aimed only to Banks and Financial Institutions, all information publicaly and privately available on the GFIEN was either issued by an Official Government body related with the publication of Sanction Lists or Alerts and or Banks and Financial Institutions that have submitted a substantiated request to the GFIEN, if you found un-updated entries you need to contact the party who initially published such registry.

How to report an Entity or Individual

You can only request inclusion of an Entity or Physical Individual in the GFIEN if such is a qualified substantial risk to the Financial Sector or if the Entity or Physical Individual in question has previously engaged in Fraud or substantial patrimonial damage against your Bank or Financial Institution, the portal accessible to your Compliance team will contain all the information that will need to be included in the report to be admissible.
If you are a Governmental body you can only request an inclusion of an Entity or Physical Individual if the Office that regulates sanction publications in your Country issues an alert or sanction against such Entity or Individual and even if you don’t manually report it the GFIEN will pick up the published list and include it in the DB.

Applicability

If you found a positive while running a check you need to determine if the sanction applies legally to your specific case. If you are not a Bank or a Financial Institution you need to check with your Lawyers, the DB consists on both open information available to the public and internal Information available only for Banks or Financial Institutions, its your sole responsibility to verify if the Positive Match is applicable to you and or if it has been removed or updated from the originating sanction list.

What to do if I find a Positive Match

Depending on the country where you are regulated it may be illegal to
conduct business with persons within this list, if you found a positive
match while running an AML Check even if you are not a Financial
Institution or Bank you may be in violation of local regulation if you
engage in business with such Entities or Physical Individuals.

You are advised to consult with your legal or compliance team to verify
the applicability of certain sanctions and if it would be possible to
deal with a positive match, the enforcement of sanctions varies from
Jurisdiction to Jurisdiction.

In some Jurisdictions you must receive special authorization from
Authorities to conduct business with positive matches in some others it
would simply be not possible.
